To consider and approve the minutes of the meeting of the Executive held on 15 February 2011.

RESOLVED that the minutes of the meeting of the Executive on 15 February together with the accompanying decision records be confirmed as a correct record and signed by the Leader.

The Executive considered the reports submitted on the items listed below and the decisions taken are recorded in the decision sheets attached to these minutes and summarised below:

To determine the Executive’s response to the recommendations in the report by the Children Young People and Learning Overview and Scrutiny Panel’s Working Group on ‘A Review of Safeguarding Children and Young People’.

RESOLVED that

1          The responses to the recommendations outlined in the supporting information in section 5 of the report be approved; 

2          The members of the working group be thanked for their report.

To present endorsement Creating Opportunities – A Joint Strategic Plan for Children and Young People in Bracknell Forest.

RESOLVED that the plan be commended to the Children and Young People’s Trust.

To approve the Secondary Education Strategy.

That the Secondary Education Strategy be approved.

To present for approval Creating Opportunities – Breaking the Cycle, a Child Poverty Strategy for Bracknell Forest.

RESOLVED that

1          The Child Poverty Strategy be approved.

2          The further development of a detailed plan by the Children and Young People’s Partnership, following the publication of the National Strategy at the end of March 2011 be approved.

To approve the Contract Standing Order Waiver in order to facilitate the  procurement of services from Connexions Berkshire for the period 1 April 2011 to 31 March 2012. 

RESOLVED that the Contract Standing Order Waiver in order to facilitate the procurement of services from Connexions Berkshire for the period 1 April 2011 to 31 March 2012.  be approved.

To seek approval to the award of contracts for the second wave of construction under the Primary Capital Strategy for Change, and the redevelopment of Kennel Lane School. 

RESOLVED that

1          The award of contract for the Phase 1 and 2 works at the Holly Spring Schools to the preferred supplier, subject to the final lump sum not exceeding the amount set out in the confidential Appendix, be approved. 

2          Approval of the awards of construction contracts for the Crown Wood Phases 2 and 3, Sandy Lane Phase 3, Owlsmoor and Kennel Lane Schools be delegated to the Director of Children and Young People and Learning, subject to the final lump sum not exceeding the amounts set out in the confidential Appendix be approved.

To consider the Streetscene SPD (including the Highways Guide for Development), for agreement and adoption, with the accompanying Sustainability Appraisal.

The Sustainability Appraisal (Appendix C) is available to view online only.

RESOLVED that

1          The Streetscene Supplementary Planning Document (including Annex 1 Highways Guide for Development), Appendix B to the report, be approved for adoption;

2          The Sustainability Appraisal, Appendix C to the report, be approved for publication; and,

3          The ‘statement’, Appendix D to the report, be approved pursuant to regulation 18(4) (b) of the Town and Country Planning (Local Development) (England) Regulations 2004 as amended.

To adopt the Local Transport Plan 3 (LTP3) Core Strategy and its supporting documentation, and to roll forward a selection of LTP2 strategies.

The Appendix 3 – LTP3 Strategic Environmental Assessment (SEA),  Appendix 4 – LTP3 Habitats Regulation Assessment (HRA), and Appendix 5 – LTP3 Background Paper will be available online only.

RESOLVED that

1          The adoption of the Local Transport Plan 3 Core Strategy (Appendix 1), the Statement of Consultation (Appendix 2) and the Associated Supporting Documents (Appendices 3, 4 and 5) be recommended to Council.      

2          The Integrated Transport Capital programme for 2011/12 (Appendix 6) be approved by the Executive subject to expenditure on the S106 programme not exceeding £750k without full Council approval of additional funds.

3          The additional draw down of £400k of Section 106 as shown be recommended to Council.

4          Authority be delegated to the Executive Member for Planning and Transport and Economic Development to agree any necessary minor amendments to the Local Transport Plan 3 Core Strategy (Appendix 1) and supporting documents prior to publication for adoption.

5          The indicative Highway Maintenance Works Programmes for the financial year 2011-2012 be approved, as set out in Appendix 7 to the report as the basis for targeting available maintenance funds.

To clarify the Council’s planning policy on affordable housing in view of the publication of various national and local policy documents since the adoption of the Bracknell Forest Borough Local Plan (BFBLP) in 2002 and the publication of Affordable Housing from Residential Development Supplementary Planning Guidance (SPG) that was approved by the Council’s Executive in 2003.

RESOLVED that

1          The Affordable Housing from Residential Development Supplementary Planning Guidance that was originally approved by the Council’s Executive on 16 September 2003 be revoked.

2          The reliance on saved Policy H8 of the Bracknell Forest Borough Local Plan (2002) together with the Council’s Housing Strategy and Planning Policy Statement 3 (2010) to seek a target percentage of provision up to 25% (subject to viability) and use of the national indicative minimum site size threshold (15 net), respectively be confirmed.

4          The approach outlined in 2.2 of the report, be included in an update of the Council's Housing Strategy.

5          The affordable housing on qualifying sites will be delivered in accordance with the delivery model set out in the Affordable Homes Programme Framework 2011-2015 (February 2011) or as subsequently updated be confirmed. This included the new affordable rent product, and, low cost home ownership such as shared ownership.

To inform the Executive of the Council's responsibility in relation to the Joint Strategic Needs Assessment (JSNA) and to receive the Executive Summary of JSNA for 2011.

RESOLVED that the information contained in the Executive Summary of the Joint Strategic Needs Assessment be endorsed.

To award a contract for Measured Term Contract for Building & Engineering Maintenance and Repairs.

RESOLVED that the Measured Term Contract for Building & Engineering Maintenance and Repairs due to commence on 16 May 2011 be awarded to Tenderer A.

To inform the Executive of the performance of the Council over the third quarter of 2010/11 (October – December 2010).

RESOLVED that the performance of the Council over the period from October to December 2010, highlighted in the Overview Report in Annex A be noted.

To consider the following motion:

That pursuant to Regulation 21 of the Local Authorities (Executive Arrangements) (Access to Information) Regulations 2000 and having regard to the public interest, members of the public and press be excluded from the meeting for the consideration of item 19 and 20 which involves the likely disclosure of exempt information under the following category of Schedule 12A of the Local Government Act 1972:

(3)       Information relating to the financial or business affairs of any particular person.

The Executive considered reports containing exempt information on the following items.  The decisions taken are detailed in the attached decision sheets and summarised below:

To award contracts for the provision of transport expenditure.

RESOLVED that

1          Subject to finalisation of contract conditions, the home to school transport be awarded to three suppliers as listed below.

2          Additionally the provision of occasional services of transport be awarded to four contractors listed below which include the successful three listed above in 2.1. Contractor D only tendered for occasional transport services and they should be listed as a preferred supplier due to being able to provide passenger services above seventeen seats.

3          Contracts be awarded in April 2011 with the go-live date being the start of the new academic year in September 2011.

To consider the Bracknell Town Centre Development Agreement.

RESOLVED that

1          The disposal of land in Bracknell Town Centre in accordance with the general terms set out in paragraph 5.2 of the associated report be approved.

2          Authority be delegated to the Chief Officer: Property to finalise the precise boundaries and exact values for the transfer of assets set out in paragraph 5.3 of the report.
