The Committee noted: · That Binfield Parish Council had recommended refusal as outlined in the report. · The 6 objections received as outlined in the report. · The supplementary report tabled prior to the meeting.
RESOLVED that following the completion of planning obligation(s) under Section 106 of the Town and Country Planning Act 1990 relating to the following measures (and any additional measures or amendments that arise during the course of drafting and agreement of the s106 obligations as advised by the Borough Solicitor); - Obligation to enter into a s278/s38 for road construction and adoption for the new road serving the site and the provision of a turning head on North View. - Phased delivery of new adoptable loop road, up to boundary and connecting with proposed road in the Persimmon Homes site. - Prior to the commencement of development, the provision of an access road will be provided from the site to Cain Road roundabout, in the event that this is not provided by Persimmon Homes. - Obligation that Moor Lane will not be used for demolition/construction traffic associated with the development. - Highways provisions for Private Access and Footways maintenance within the site and the turning head on Moor Lane. - Prior to the commencement of development all the existing uses within the development site will cease. - Travel plan. - On-site Biodiversity Net Gain maintenance obligations and monitoring fee. - Contribution towards off-site BNG units. - Formula to enable a top up/ reduction if revised metric figures change. - SuDS maintenance obligations and monitoring fee. - S106 Obligation monitoring fees.

An amendment was moved by Councillor Smith and seconded by Councillor Temperton to condition 3 as follows:
03.Prior to the implementation of the 24 hour use of the gym hereby permitted, a car park management plan shall be submitted to and approved by the Local Planning Authority for the ongoing management of the car parking areas to serve the development covering signage and other measures to be taken by the gym to manage car parking areas and details of CCTV to be operated within the car parking areas.
Details to be submitted in relation to Condition (03) shall include: a) A drawing showing the location of parking areas to be used by staff and customers during more noise sensitive hours. b) Full details of all measures to be taken by Energie Fitness to ensure both staff and customers are aware of these parking areas and the need to ensure that the amenity of neighbouring residential properties is protected. c) Details of CCTV (including location and monitoring system) and any other management measures intended to prevent any anti-social behaviour and misuse of the car park. d) Details of a review mechanism which will operate in the event that the Local Planning Authority notifies the operator that complaints have been received about noise disturbance caused due to use of the car park by gym users. The review mechanism shall set out the timing for the submission of a supplementary car park management plan for approval in writing by the Local Planning Authority which shall include additional measures to be implemented in order to address the issues raised.
The car park management plan shall be implemented prior to the implementation of the 24-hour use of the gym. Any supplementary management plan approved pursuant to d) shall be implemented within 1 month of its approval. The car park shall be managed and maintained in accordance with the approved plan(s) thereafter.
