Minutes:

The minutes of the meeting held on the 12 September 2024 were approved as a correct record.

 

Councillor Virgo made the following statement regarding the meeting held on 12 September 2024: To the Chair and those present at the hybrid Planning Committee including both those in the chamber and on teams on 12 September 2024. During my comments on the S73 application 23/00204/Ful Land at the Yard Chevey Down Road Winkfield Row Bracknell Berkshire. I stated in error that the mound which sits outside the red line of the application boundary was caused by the administrator’s development company as well as by the development company itself. I accept that this is not true. While the role of the administrators is to have conduct and control of the companies’ assets, the mound was constructed long before the administrators took on such role. The mound was constructed long before the developers company went into administration. I also note that in the supplementary planning report, dated the 11 September, there was no specific provisions concerning the mound. How it was generated and who was responsible and furthermore that the administrators are pursuing third parties to rectify the unlawful dumping that has created the mound through several procedures. As the Committee will understand I have dealt with many issues on behalf of residents over many months rising from my dissatisfaction with the mound, which led to the prominence I gave in my considerations. Although I recognise in terms of the application it is not a material planning consideration, I therefore apologies to the administrators as well as to the Committee for this incorrect statement.

 

Jo Male, Assistant Director: Planning made the following statement regarding the meeting held on 12 September 2024:

At the September Planning Committee, it was presented by officers that no CIL payments or SPA contributions had been received for the site, Land at the Yard Chavey Down Road Winkfield Bracknell Berkshire, which was factually incorrect in respect of the CIL payments. No SPA contributions have been paid for this site. Upon making enquiries it has been established that a CIL payment of £450,950 was cleared in April 2019 and £206 which cleared in June 2019. A further sum pertaining to interest charges was also invoiced and received. The Council is in discussions with the administrators of the company over outstanding CIL charges and SPA contributions payable under the S106 agreement which remains outstanding. All CIL payments made are fully recorded. Whilst this was not a material consideration for the Planning Committee, the above has been provided for clarity and transparency.

Declarations of Interest

Members are asked to declare any disclosable pecuniary or affected interests in respect of any matter to be considered at this meeting.

 

Any Member with a Disclosable Pecuniary Interest in a matter should withdraw from the meeting when the matter is under consideration and should notify the Democratic Services Officer in attendance that they are withdrawing as they have such an interest. If the Disclosable Pecuniary Interest is not entered on the register of Members interests the Monitoring Officer must be notified of the interest within 28 days.

Councillor Barnard declared an interest in Item 22/00150/OUT Land At Priory Fields Newell Green Warfield Bracknell Berkshire as it relates to land adjourning to Warfield Community Hub which he was involved with as chair of the Warfield Parish Council.

·       The representations of the two public speakers at the meeting.

 

A motion to APPROVE the recommendation in the officer report was proposed but fell at the vote.

 

Therefore, an alternative motion to REFUSE the application was proposed and seconded, and on being put to the vote was CARRIED.

 

RESOLVED That application 24/00428/FUL be REFUSED for the following reason:

 

1.     The addition of the dormer window, increases the bulk and the massing of the garage and would, as a result of its siting and design, have an unacceptable overbearing impact upon the adjacent dwelling and within the street scene contrary to Policy LP 50 of the Bracknell Forest Local Plan and the Design SPD.

RESOLVED that following the completion of planning obligation(s) under Section 106 of the Town and Country Planning Act 1990 relating to the following measures (and any additional measures or amendments that arise during the course of drafting and agreement of the s106 obligations as advised by the Borough Solicitor);          

 

-        Contributions towards measures to avoid and mitigate the impact of the residential development upon the Thames Basin Heaths SPA.

-        Affordable Housing Scheme to include a minimum of 35% affordable dwellings and 5% accessible dwellings.

-        Requirement to enter into s278 and s38 agreements for construction of access, roads, footways, cycleways and subsequent adoption.
