RESOLVED that the application is recommended for conditional approval subject to the satisfactory completion of a deed of variation to the original s106 agreement. This will vary the original agreement by incorporating.

 

(1) reptile mitigation measures (e.g. requiring the incorporation of a Reptile Management Company to secure the ongoing management and maintenance of the Reptile Mitigation Area),

(2) secure obligations regarding landscaping

(3) to secure the implementation, management and maintenance of the access with associated lighting and drainage,

(4) to update the highways obligations to reflect the current status of the development and

(5) to secure the outstanding SPA financial contribution upon completion of a deed of variation to the original s106 agreement.

RESOLVED That the application be REFUSED for the following reasons:

 

  1. The development would not provide adequate on-site parking and turning for all the existing/proposed uses at the site, including delivery and emergency vehicles and it has not been demonstrated that there is adequate space for vehicles to manoeuvre within the site to enable them to exit in a forward gear. There would be an intensification of use of the substandard access onto Dukes Ride which has insufficient width for vehicles to pass and insufficient visibility. The proposal would therefore lead to an increased risk of conflict between road users, increase overspill parking within the surrounding area, and would not provide safe and suitable access to the site for all users. As such, the proposal would result in an adverse impact on highway safety, contrary to Policies LP 25 and LP 62 of the Bracknell Forest Local Plan, the Council's Parking Standards Supplementary Planning Document and the National Planning Policy Framework.

 

  1. In the absence of a planning obligation to secure suitable avoidance and mitigation measures and access management monitoring arrangements, in terms that are satisfactory to the Local Planning Authority, the proposal would be contrary to Regulation 63(5) of the Conservation of Habitats and Species Regulations 2017 (as amended), Policy NRM6 of the South East Plan, Policy LP 32 of the Bracknell Forest Local Plan and the Thames Basin Heaths Special Protection Area Supplementary Planning Document (2018).
