RESOLVED that the minutes of the meeting of the Committee held on 18 June 2020

be approved as a correct record and signed by the Chairman.

Declarations of Interest

Members are asked to declare any disclosable pecuniary or affected interests in respect of any matter to be considered at this meeting.

 

Any Member with a Disclosable Pecuniary Interest in a matter should withdraw from the meeting when the matter is under consideration and should notify the Democratic Services Officer in attendance that they are withdrawing as they have such an interest. If the Disclosable Pecuniary Interest is not entered on the register of Members interests the Monitoring Officer must be notified of the interest within 28 days.

 

Any Member with an Affected Interest in a matter must disclose the interest to the meeting.  There is no requirement to withdraw from the meeting when the interest is only an affected interest, but the Monitoring Officer should be notified of the interest, if not previously notified of it, within 28 days of the meeting.

Minutes:

Councillor Virgo declared an affected interest in agenda item 6, he would participate in the debate but not take part in the vote.

 

Councillor Mrs McKenzie declared an affected interest in agenda items 5 and 6.

 

It was therefore agreed that these items would be taken at the end of the meeting and Councillor Mrs McKenzie would leave the meeting prior to its consideration.

The Committee noted:

 

·        The additional information contained in the supplementary report of the Head

of Planning tabled at the meeting.

·        Winkfield Parish Council’s objections, as detailed in the agenda papers.

·        A total of 13 objections from neighbouring properties as summarised in the

·        agenda papers.

·        The representations from a speaker on behalf of the objectors who joined the meeting.

 

 

A motion to approve the recommendation in the officer report was proposed but not seconded.

 

Therefore an alternative motion to refuse the application was proposed and seconded, and on being put to the vote was CARRIED.

 

RESOLVED that application 19/00857/FUL be REFUSED for the following reason:

 

01. The development of part of the parking area currently serving the restaurant would result in a loss of off-street parking to the restaurant reducing the number of off-street parking spaces to further below adopted standard within the Parking SPD. The applicant has demonstrated that this would result in vehicles at peak times having to park on the highway in an area where the majority of houses have no off-street parking resulting in a high demand for the available on-street parking. It is considered that the additional vehicles will increase the demand for on-street parking resulting in a highway danger, contrary to Policy CS23 of the Core Strategy Development Plan Document, 'Saved' Policy M9 of the Bracknell Forest Borough Local Plan, Parking Supplementary Planning Document, supported by the NPPF (2019) particularly paragraphs 108 and 109.

 

02. The occupants of the development would put extra pressure on the Thames Basin Heaths Special Protection Area and the applicants have not satisfactorily mitigated the development to comply with the Thames Basin Heaths Special Protection Area Avoidance and Mitigation SPD (29 March 2012). In the absence of a section 106 planning obligation to secure suitable mitigation measures, the proposal would be contrary to Policy NRM6 of the  South East Plan, Policy EN3 of the Bracknell Forest Borough Local Plan and Policy CS14 of the Core Strategy Development Plan Document.

Following the completion of planning obligation(s) under Section 106 of the

Town and Country Planning Act 1990 relating to the following measures:

RESOLVED that the Head of Planning be authorised to APPROVE application 20/00296/FUL subject to the following conditions amended, added to or deleted as the Head of Planning considered necessary:

 

01.            The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

RESOLVED that the application be REFUSED for the following reason:

The proposal is considered to be inappropriate development within the Green Belt. There are no very special circumstances which outweigh the harm to the Green Belt by reason of inappropriateness. The proposed development is therefore contrary to  Policy CS9 of the Core Strategy Development Plan Document, 'Saved' Policy GB1 of the Bracknell Forest Borough Local Plan and the National Planning Policy Framework.

RESOLVED that the application be APPROVED subject to the following conditions:-
