Application for prior approval for the change of use of existing office (Class B1) to residential use (Class C3) comprising 32 apartments.

 

The Chairman reported that the Committee needed to take a decision on this application in the next 56 days, if they did not, deemed consent would be granted.

 

The Committee noted:

 

·         The supplementary report of the Head of Planning tabled at the meeting.

·         The objection detailed in the supplementary report.

 

It was RESOLVED that Prior Approval be granted. The proposal would therefore comply with Class O of Part 3 of Schedule 2 of the Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).

The Committee AGREED that Condition 17 be removed.

 

It was RESOLVED that the application be APPROVED subject to the following conditions:-

 

01.     The use hereby permitted shall be carried on only by LUK Events Ltd and when the land ceases to be occupied by LUK Events Ltdthe use shall cease.

REASON: - The site is located outside of a defined settlement where it is the policy of the Local Planning Authority to restrict such use of the land and planning permission is only granted because the use is temporary in nature for three months of every year with all structures been cleared from the land in the intervening period of this seasonal event.

02.     The development hereby permitted is granted for a limited period and restricted as follows:
