Declarations of Interest

Any Member with a Disclosable Pecuniary Interest or an Affected Interest in a matter should withdraw from the meeting when the matter is under consideration and should notify the Democratic Services Officer in attendance that they are withdrawing as they have such an interest. If the Interest is not entered on the register of Members interests the Monitoring Officer must be notified of the interest within 28 days.

To consider the following motion:

 

That pursuant to Section 100A of the Local Government Act 1972, as amended, and having regard to the public interest, members of the public and press be excluded from the meeting for the consideration of the following item which involves the likely disclosure of exempt information under the following category of Schedule 12A of that Act:

 

(1)        Information relating to any individual  (Item 4).

Minutes:

The Panel decided that the hearing should be adjourned, however the Panel expressed concern that the appellant had failed to provide sufficient and specific medical evidence that he was unfit to travel to and attend a panel hearing as had been requested by the Licensing Officer.

 

The Panel heard that the appellant felt that this was an unfair request. On the contrary, the Panel were clear that this was a very reasonable and necessary request. The medical evidence provided to the Panel to date stated that the appellant was not fit to work, however the appellant had failed to provide any evidence to state that he was unfit to travel to and attend a hearing. A person can be unfit for work but fit to attend hearings.

 

The Licensing Panel hearing would now be held on Wednesday 7 September 2016 at 2pm in the Council offices at Easthampstead House. If the appellant were unable to attend on this date, medical evidence would need to be provided demonstrating that he was unfit to travel to and attend a hearing. If the appellant did not attend and had not provided this specific medical evidence, the Panel would proceed and conduct the hearing in his absence.
